Tweed Valley Wilding – Scotland

These Terms and Conditions (“Terms”) set out the agreement between you (“the Participant”) and [Tweed Valley Wilding] (“the Company”, “we”, “our”, or “us”) when booking and taking part in any activity or event organised by us.

By booking a place on any of our activities, you agree to accept and abide by these Terms.

1. Booking and Payment

  • Bookings are confirmed when full payment or a deposit (as stated at the time of booking) is received.

  • Any balance must be paid no later than 4 weeks before the start date of your activity.

  • If full payment is not received by the due date, we reserve the right to cancel your booking and retain any deposit paid.

  • Prices quoted include all elements outlined in the trip description at the time of booking. Any additions after booking will incur additional cost.

  • Any booking made through a second company ie Wild Dook Sauna or Cedar Hus is subject to their Terms and Conditions.

2. Cancellations and Refunds

By the Participant

Cancellations for individuals can be made by phone or by email. Group bookings must be cancelled by email.

The following cancellation fees apply:

Individuals

  • More than 5 days: full refund less an 8% admin fee, rescheduling is available.

  • Less than 5 days: 100% refund as a voucher, rescheduling is available.

  • Less than 24 hrs: no refund.

  • No shows are not refunded.

  • Our sessions go ahead in all weathers, provided it is safe. If the session runs but the participant doesn’t wish to attend no refund is available.

Group Bookings

  • More than 8 weeks before the start date: deposit refunded.

  • Less than 8 weeks before the start date: deposit retained.

  • Less than 4 weeks before: no refund

We recommend all participants take out comprehensive travel insurance to cover any cancellations and regret that no compensation or other monies will be payable (for example, the cost of any travel or accommodation arrangements you have made independently).

By the Company

  • We may cancel or alter your booking due to weather, safety concerns, staff illness or other business circumstances.

  • In the event of cancellation by us, you will receive either a full refund or the option to transfer to another date, but we are not liable for any other costs incurred (e.g. travel, accommodation).

  • In poor weather, we may alter swim locations, shorten sessions, or substitute activities to maintain safety, no partial or full refund is available under these circumstances.

  • Cancellation due to circumstances beyond our control, including natural disaster, war, government action, pandemic or terrorism will not be refunded.

3. Weather and Environmental Conditions

  • Scotland’s weather can be unpredictable. Conditions may change rapidly, affecting safety and session plans.

  • The guide has final authority to cancel, amend, or shorten a session if safety may be compromised. Safety always over rides expectations.

  • Refunds or partial refunds are not available for a session adapted or curtailed on safety grounds.

4. Assumptions of Risk

Outdoor activities and wild swimming involve inherent risks including cold water, remote locations, and changing weather. Full risk assessments have been carried out and all possible reasonable adjustments are made to minimize risk. By participating, you acknowledge and accept there are risks including and not limited to those detailed below and are happy to assume full responsibility for all risks involved.

Terrain and access 

  • When walking or moving around a location there is a risk of slips, trips and falls.

  • Once enroute it is your responsibility to be vigilant to the terrain and alert the guide to any difficulties.

  • The walk to and from the swims are likely to have ticks. It is your responsibility to check yourself for ticks after the session and remove them appropriately.

The swim

  • Initial increase in heart rate and blood pressure upon entering cold water

  • Injury when entering or exiting the water

  • Injury from collision with submerged or visible objects in the water

  • Injury from wildlife in or around the area

  • Injuries sustained while swimming in higher-risk areas such as in waterfall pools, rivers, ice and the sea

  • Sickness or disease from polluted water

  • Hypothermia

  • Drowning

Additional activities

Injury or accident occurring from any other event activity including but not limited to kelly kettles, firepit activities, use of hammocks and the consumption of foraged and non foraged foods.

5. Health, Fitness and Medical Disclosure

  • Activities, terrain and distances are listed on each activity. It is your responsibility to famailarise yourself with the activity description before booking and only book if you are suitably physically fit to manage the terrain, distance and conditions described for the session.

  • You must declare any relevant medical conditions at the time of booking through the confidential digital registration form and inform us of any changes prior to the trip.

  • For Group Bookings it is the organisers responsibility to ensure all participants have received and complete the digital registration form.

6. Age and Ability

  • Participants must be over 18 unless agreed beforehand with Tweed Valley Wilding.

  • Any participants under 18 must be accompanied by an adult who is responsible for them during the session.

  • For swim sessions it is not necessary that you can swim any distance but you MUST have informed Tweed Valley Wilding if you cannot swim.

7. Equipment and Personal property

  • For all sessions participants must come to sessions suitably dressed for the changeable Scottish weather with warm waterproof clothing, hat, gloves and sturdy footwear suitable for walking on uneven ground. If swimming extra layers of clothing to put on post swim must also be brought.

  • For swim sessions participants must supply their own personal swim kit including swimsuit or wetsuit, towel and gloves and hot water bottle if desired in the winter unless agreed in writing beforehand.

  • It is essential that all participants supply their own protective foot wear for in the water, unless agreed in writing beforehand.

  • Many swim sessions require the use of tow floats for safety, if participants don’t have their own they can be borrowed from the company for the session.

  • We will provide all other necessary equipment unless stated in the session description.

8. Behaviour and Removal from Activities

  • All participants must follow instructions given by guides and support staff at all times. Failure to do so may result in removal from the activity without refund.

  • Alcohol and drug use are strictly prohibited during any swim session or immediately beforehand. Any person attending suspected of being under the influence of alcohol or drug will be refused participation in the session with no refund available.

  • We reserve the right to refuse participation in a session without a refund if we believe that doing so would compromise personal or group safety.

9. Insurance and Liability

  • The Company is insured for Public Liability. This insurance does not cover personal accident or loss of private property.

  • We cannot be held responsible for your safety if you do not adhere to the safety guidance, instruction and decisions made by your guide.

  • Participants are advised to arrange their own personal accident and travel insurance, including cover for outdoor or water-based activities.

  • You acknowledge that participation is voluntary and at your own risk.

  • The Company and its guides are not liable for any injury, loss, or damage unless caused by proven negligence.

10. Photography and Media

  • We may take photos or videos during swim events for promotional use (website, social media, printed material).

  • Please inform us in advance if you do not consent to your image being used.

11. Complaints

  • We work hard to provide a safe and rewarding experience. If you are unhappy about any aspect, please speak to your guide as soon as possible so we can address it during the trip.

  • Formal complaints must be submitted in writing within 14 days of the event.

12. Governing Law

These Terms are governed by the laws of Scotland and any disputes shall be subject to the exclusive jurisdiction of the Scottish Courts.
